This may be a bit peripheral, but...
If a union is faced with the right to engage only in effects bargaining, by definition that union cannot directly negotiate what it is most concerned about, that is the substance of the proposed changes. Often the best strategy available is to make it cumbersome and costly for the employer to proceed, in hopes that the result will be a partial or total retreat. A valuable tool for doing this is to pursue information requests. These can often be made easily and quickly by the union, but place substantial compliance burdens on the employer. And for the most part, the legal landscape in this area is far more union-friendly than is usually the case.
I've attached a writeup I've done on the various tools that can be used to make information requests. I hope it is of some use.
